I did not have my I-140 notice, so I emailed my attorney and he replied with a copy of the I-140 which had the priority date.

USCIS might re-start PP for I-140 once they complete receipting 485 applications and EAD, AP approvals for July and August filers..which may take atleast 3 to 4 more months!!

I have got exactly the same RFE.....i am going to send the same documents and hoping that this is enough. There was one question that was bothering me on my i485RFE. It started like this...............
Your FORM I485 Application Must be accompanied with two colored Photographs.................
I am confused if they mean that i should re submit the i485 application or just the letter taht came with it.
i also never got any colored sheet as i have heard most of the people got. Is this normal practise or something i should be conserned about

Medical results are valid till 1 years from the date they are done. Also if you got it done from a uscis approved doctor u r all set.
Lot of ppl get vaccination and everything done before hand.
Check with ur lawyer, but as far as i know it should be good.

One of my friends lost his Petition papers. His H1-B visa is about to expire and he wants to file for an extension. Currently he is in India and was planning to travel to US this week, when he lost his petition papers.
Will it be possible for him to travel to US without his Petition papers and apply for a duplicate / extension?
Please let me know any help line number where he can call to clarify his doubts.

It's not clear what you really mean.
You say your employer has agreed to file your AOS papers but has not agreed to proceed with the processing. Isn't that one and the same?
Besides you should ask for exactly what the risk is.
Maybe hiring your own immigration attorney or a consult is the best to get your facts straight.

I applied for I 485 , AP and EAD during 07 July. I got a fp notice back in 2007 and I got another one two weeks ago. I went ahead and did my bio-metrics over the weekend at TSC Application Support Center.
Does this mean that somebody has looked into my file and pre adjudicated it? or is it a automated thing and does not mean anything?

I travelled on mine 3 months after it was issued ( delay in getting wife's visa). I was questioned at the airport about the delay in travel. Explained the delay and got entry. It may be possible that they may like to speak to your immediate boss (carry his office and cell numbers)
I think (my opinion) that Visas remains valid as long as the job offer, with the same company, is valid.

I had ask these questions on the attorney calls few months ago and this is what i got from it.
The questions are:
1. Can I file an extension of H1 with pending MTR and with less than year old labor application?
- No, need to have approved I140 in your case.
2. Is it legal to stay in US after May 2011 while MTR is pending and H1 extension is filed before expiry?
- Cannot file H1 extension with that
3. In case, if the MTR is denied, would the illegal/out of status will start from 15th May 2011 or from the date the MTR is denied?
- i think yes.
Please consult a lawyer to get reliable answers/second opinion.

Currently, I am on H4 visa. Recently, I was offered employment and got my H1B approved.
But, my new I797 approval notice does not contain I-94 part.
Do we need to apply for Change of Status from H4 to H1B now while I remain in US? Do I need to do it or my employer needs to do it?
I would really appreciate your help.

You need to go out of US, preferably to your home country, get an H1-B stamp on your passport, and reenter US using your H1-B visa stamp.

My friends received Green cards in 2007. They live abroad, but make regular trips tho the Us to visit family and maintain their GC.
Unfortunaltely, they recently misplaced their green cards. They are planning a trip to the US this month, for which they have received travel letters from the US Embassy abroad.
Would anyone know what the process is afterwords? We know they have to file I-90s to replace their lost GC. Does this have to be done at the port of entry? Or is it done at a local office on reaching their final US destination?
Also, will they be called for a biometric appointment locally or can that be done at a Port of Entry. Can the biometric be done at a location abroad?
If anyone has any info on this, it'd be truly appreciated.

In 2005 I (american citizen) applied for a I-130 petition for my husband who is an Indian citizen. (It was approved.) Then after that the case was placed under administrative review at the Mumbai embassy in India. It is still pending for over four years now. As of Sept. 2008 My husband recieved a letter stating the petition was sent to the USCIS here for review and possible revocation. We were told to contact them here for our case. They can not find anything on our case.
He is now in Canada on a student visa. Can I apply for a K-3 visa while he is in canada on a student visa? I was told he would need to go back to India for me to apply for a K-3 visa. USCIS agent told me to take the steps in applying for a K-3 visa for him.
