Tough times are upon us again. Been there, like I'm sure many of us have - fresh graduate in '01 coming out in a recession & survived, recovered, only to face another, maybe worse, in '09-'10.

The U.S. Department of Labor Employment and Training Administration Office of Foreign Labor Certification, issued a Frequently Asked Questions on Permanent Labor Certifications, titled Round 12.
In that update they answer the employer point of contact questions that is often asked by employers. The answer is that the employer must designate as its point of contact an employee of the employer who is authorized to act on its behalf in labor certification matters pertaining to the specific job opportunity for which certification is sought.
The designated employee may not be the sponsored foreign worker. The employer point of contact will be contacted by the National Processing Center to verify whether the employer is authorizing the filing of the application and sponsoring the foreign worker named therein.
Therefore, an authorized employee�s name and contact information must be listed in Section D of the employer�s submitted ETA Form 9089. It is not acceptable, for example, to reenter the employer�s name listed in Section C of the ETA Form 9089 or provide a generic title such as �HR Manager.�
Moreover, as indicated on the ETA Form 9089 and accompanying instructions, such a person�s name and/or contact information, e.g., the phone number and email address, must be different from the attorney or agent name and/or contact information listed in Section E of the ETA Form 9089, unless the attorney or agent is an employee of the employer. My wife did call the National Customer Service Center and opened a service request too. But we have not heard anything yet. We tried getting an infopass appointment but none is available in our area. We will try it again tomorrow. I am kind of surprised how this can happen because in the USCIS database, approval of derivative application requires a check on primary application approval first. This is what I have been told by another lawyer.

I had the same problems 3 weeks back for B'bay. We had to submit all papers atleast 5 days in advance to VFS office in Ahmedabad. They refused to accept my papers. I had to cancel that application and submit a new one with Regular H1B instead of Visa Renewal. Luckily, VFS accepted my application papers which i sent to my relatives in email. I signed the papers once i reached consulate.

Just got 3 transfer notices from CSC saying applcations transfered to NSC. Applcations reached July23rd at NSC. 140 approved from TSC.

In the application filed, I received a query stating "Labor Condition Application is marked to indicate you are an exempt HIB dependent for the beneficiary based on the existence of masters degree from the United States. Please confirm your claim that you are an expemt for this beneficiary. If no United States masters degree exists for this beneficiary, the LCA is not valid and may require a withdrawal of the current petition and filing of a new petition with a new LCA that adhers to Labor Department's requirement for H1B dependents".

My AP is pending and my H1 visa on passport has expired like 3 months back. I am on valid H1 status which is good for another 3 years till 2010. I have scheduled H1 stamping renewal interview in India. Can there be any problems in H1 visa stamping as my AP application (I131)is still pending?

Actually your friend wants to go to the local Customs and Border Protection office, not USCIS. I would recommend calling first as many CBP offices have specific times when they will accept walk-ins for issues such as this.

I don't know if here is right place to post this or not. I responded to RFE about 30 days ago and got an email update that TSC has got my response and the case processing is resumed. That was 485 and TB skin test that I had to do again.
Anyone has any idea what is normal time after response to RFE? I am EB3 with PD of Oct, 2003.
Do you recemmend me to call service center or go for infopass?

Hi JSaradhi,
When you got your renewal for your H1b till 2008, you should have also received a new I-94 card with a new validity on it, probably till 2008. I know this because I also recently got my H1b renewed.
Check with your employer. They should have handed over the new I-94 to you.

I just read somewhere...that if I do not file by I140 by July 31 the i lose chance to file I485 by august 17..which i could file anyway together if I have to file it by July31..Is this true..
the reason being that I am waiting for the hard copy of Labor Approval and the only thing I have is Cover letter copy..I do not want to miss chance

I think its only for labor exempt cases. Since your PD is 2001...u r fine to file by aug17th
Some people here say LC must be cleared by July 31st...so u r fine that way too. Your LC will say a approval date in July...so u r ok...(eventhough some argue that its not important)

It does not say that H1B workers lack any courage and will power to stand up for themselves. They lack unity, are narrow minded and cannot work together. Their high education works in their disadvantage because they use to fight within themselves. as long as your gc is pending, you can get 1 year extension. After 140 approval and 485 still pending you can get 3 year extension. OR you can apply for EAD to continue in status.
