My employer has job posting Bachelor's degree with 7 years of experience but does not say anything about Masters Degree. Wanted to know this job requirement fall under EB2 or EB3?. appreciate for the response.
The advt is very sensitive. My friend lost his eb2 chance because of that.
its MS or Bachelor's degree with PROGRESSIVE experience.
Did you got it screended with your/company attorney about the advt description

Yes you would need a transit visa. In fact in Air India (not sure about other airlines) without transit visa you cannot even board the plane from US

My Company recently started Perm process and posted ads in newspaper and jobsites. We have recieved couple of resumes. One of the resume meets almost all requirements, but doesn't have enough experiance in one skill set and also doesn't have required Bachelors Degree
Do we need to do interview candidates before rejecting?

i think majority of the Eb2 filings are under audit..
i ran my first ad..this sunday..and my lawyer didnt say a thing abt change in perm process.. but he did mention that Eb2 are being scrutinized more.
i think ur desi consultant is afraid of being under the scanner ! ;)

Hello friends - the recd. date on my 765 application is August 7th...it's almost 90 days now (11/5 - next monday) that my application will be pending.!
Same is the case with AP..! No news at all for EAD & AP..Worried now!
Can i make a appt. with INFOPASS for both my EAD & AP together...? And what is the A # that they ask for when we fill Infopass appt.? Is it A # on 48 receipt notice.? OR A # on 140 approval notice.!

99.999999 % of the people on this forum are Employment Based applicants who do not need interview. That was the reason.

As such there is no requirement on the time limit. But generally the supporting documents include 3-6 months latest statements of savings account. As per general advice the account balance should be atleast 5K per person (so if you are applying visitor visa for 2 persons it is 10K).
I recently applied visitor visa for my in-laws and they got the visa. I gave 4 months of latest bank statements. The visa officer didn't check any supporting documents as such but they did ask from when your daughter and son-in-law are staying in USA?
So bottom line is if it is necessary you can try your luck, else wait for few more months.

H1-B Extension after 6 years.
Is it mandatory that I have to work at the employer who is processing my GC to get the extension on H1-B beyond 6 years?
I have changed my employment after I-140 approved. But the previous employer agreed to continue the GC process. I could not file 485 due to PD is not current.
The 6 yrs limit on H1 is about to be over.
Is it possible to extend H1-B after 6 yrs at the new employer, based on the I-140 approved by previous employer as green card is process? Or is it mandatory that I have to work at the employer who is processing my GC to get the extension on H1-B beyond 6 years?

In order to extend H1B beyond six years, you do not require to be with the GC sponsoring employer. One must have filed a labor 365 days before 6th year end date. 1 or 3 years extension is based on what stage of GC processing you are in. Hope this helps!

To my knowledge H1B extension is just like a new H1B application ofcourse 6 years window will be couted here and you have spent just 3 years. To me you can file H1B extension with multiple companies. But its better to file it with original company to be on safe side, onece the extension approval come ytou can trasfer it whereever you want.

You dont have to apply for a COS as long as she is leaving US before her current I-94 expires. However, note that when she goes for her H4 interview, she might be asked to prove her H1 status by showing her employment details (recent pay checks, tax documents..) in addition to your employment documents before they give her the H4 Visa...This happened with one of my friends at Chennai embassy...Just wanted to give you a heads up on that....

Looks like there is a huge backlog of perm applications. I am not sure if they will look at your application anytime soon. If your application is pending more than a year at least you could apply for extension of H1.
It will be delusional on our part to think that perm applications will have an easy approvals.

Does anyone have any experience how long it takes to get the Canadian visa if my family members who are visiting were to travel to the Canadian Consulate in Seattle.
Earlier you used to get on the same day (in matter of hours), but apparently in March of this year, they changed their policy. "Minimum 24 hours" is not a very helpful indicator for planning :(

Applications submitted in person are accepted during our walk in hours Monday through Friday 8am to 10am. Effective March 8, 2011, applications submitted in person will no longer be processed on the same day. The minimum processing time will be 24 hours. Passports will not be returned until processing is completed. Processing times for mail in applications vary, please allow at least 4 weeks for processing. The Seattle Consulate does not provide expedited service, if you have urgent travel, it is recommended that you apply in person.

The information that is provided in this post is relevant as of Friday May 15, 2009. This is coming from our local AILA chapter Chair.
As many of our readers know, at the conclusion of the Marriage based adjustment of status interview, the immigration officer, upon approval, used to stamp the immigrant's passport with the I-551 (Green Card) stamp. This used to be an immediate proof that the case was approved and the applicant could work and travel using this stamp. As the actual production of the Green Cards became so fast, the practice of stamping applicants' passports stopped as well in most states across the nation.
It seems that things are changing, hence the recent notice from USCIS. According to the notice we received, the Green Card Facility in KY is undergoing renovation. USCIS' card production capability will be reduced over the next several months. They will expand the use of ADIT Temporary Green Card stamps as temporary evidence of LPR status.
The Stamps will be valid for 12 months (previously only 30 days validity was given). Work permits and travel documents (advance paroles) will be collected at the interview from the clients. The stamp will be the only proof of work and travel authorization in such cases. It looks like this policy will continue for the next 6-12 months. This is a nationwide policy and is not taking place only in San Diego.
We will keep you posted with more information as it becomes available.

I have read on this forum and an immigration lawyer also confirmed to me that knowing the I40 receipt number itself is enough. She said that I can print out the case status of I140 approval from USCIS website and use it. Though I did not take the job offer for which I needed this information so I have not used it.
FOIA should not take 8 months.. I applied for it at end of Jun and my number was around 3900 and it is now around 800 so I expect to get it in next 1 month so FOIA should give you copy of I140 in approximately 3-4 months.
