I posted this on my facebook. Just to spread the message. I think most people think immigrants steal their jobs, but the truth is sometimes we struggle to hire a local person and then a foreigner walks in with the skills we need, but we can't hire him. (this is not to say we have not had good quality local people for the job as well)

Hi,
Company B has applied for I-140 and 485 because you will work with them for a min of 6 to 12 months after getting GC.
So its not required for you to join them if they have already submitted I-140 and 485. You can say that you will join them after getting GC.
And if the 485 takes more than 180 days for the approval from the receipt date you can apply the AC21 portability rule and submit a new employment offer from anycompany and you can join that company.(Provided I-140 is approved and if I-140 is pending for more than 180 days then you can port the I-140 priority date by restarting the whole GC process)
Above is the knowledge I got from IV and google.
So u dont need to worry and join the company B, but keep them happy since they have to respond to all RFE till I-140 is approved.

That actually is the right way to do it.. Once your project is done technically your H1 is expired and you need to return to your home country.
Yes, you can file for a transfer and travel anywhere you want but for reentry you will need the transfer notice or approval notice from the new company, which can be mailed to you. If you already have a visa stamp then just show the new approval (transfer) and they will let you come in.

For B-2 visa for my parents do i need to send the I-134 or is this a thing of the past?

They may not accept a certificate from india, medical exams has to be done by a civil surgeon in your area who is authorized to perform the tests.

I applied on July2nd, I got the receipts on september7th and FP for oct23rd but no EAD yet! I have seen most of them get EAD but no FP, Does it matter which comes first should I wait sometime after FP for EAD?

I have a original copy whereas the lawyer has the approved I140.
Should I ask for the original or is that copy good enough?
This is taken from the 495 instructions:
Evidence of eligibility.
Based on an immigrant petition.

Here is the journey:
Nov.2002 - RIR Labor filed in CA
June 2006 - Labor approved from Phily BEC
July 2006 - I-485 , I-140 filed at TSC
Sept.2006 - I-140 approved
Got stuck in namecheck ( name check may be still pending )
May 20, 2008 - RFE received for missing TB Skin test ( doctor screwed up)
June 4, 2008 - Responded to RFE

But don't worry about it too much (what can you do). Get your next job ASAP, and file for "premium processing".
In the past "extension of status" petitions had got approved even after almost a month gap, with good explanation. But you can never count on that.
Worst thing that can happen for a valid new H1 job is USCIS approve your H1 but reject your "extension of status" (I797 without I-94 attached). In that case, you might need to travel outside of USA and get your visa.
Either way, don't go beyond 180 days. There will be additional consequences.

Lets see but i dont think senators are dumb in these too , it took them that much time to CIR and its not that easy to pass something in the same class overnight yes we need to vigilent and if needed we can start our campaign rightly said , we need to keep friends close and enemies closer. Does it impact I140 processing if i am outside US and worked with same employer in India ?
I have left for india assignment after concurrent filing (I 485 + I 140)
for 4 weeks and joined back in US for different assignment last year after July filings.
But i have maintained my old residence status and applied for change of address when i came on different assignment and loaction in US.
Has any one experienced similar situation ?
Does on US payroll becoming inactive for some duration ( in my case 4 weeks) make the I40 processing questionable ?
Can anyone advise ?

I had the same issue and I didn't write down the receipt number and USCIS customer support wasn't helpful to get the number. Now I am stuck and can send the support document only after receiving notification mail.

You should speak with a contract or employment lawyer in your home state about this. The rules on these agreements vary from state to state, and the agreements are often not enforceable. Even if the reimbursement agreement is enforceable, an employer can never ask an employee to pay the training fee ($1500 or $750, depending on the size of the company).
